Amid pushback from Democrats, the Justice Department and Department of Homeland Security are continuing a crackdown on noncitizen voting less than three weeks ahead of Election Day.
On Thursday, U.S. Attorney Ellis Boyle of the Eastern District of North Carolina announced 10 noncitizens were indicted for illegally voting in North Carolina, a key Senate battleground in the midterm elections.
One of the 10 was an illegal alien, and all allegedly cast illegal ballots in the 2024 election, according to the Justice Department. One of the noncitizens allegedly voted in eight elections across two decades, and another allegedly voted in six elections. Four of the 10 allegedly voted in multiple elections.
“There is no more important right a citizen possesses above the right to vote. All other rights flow from this Constitutional principle when we the people select our government. Every non-citizen who chooses to illegally vote subverts our constitutional republic, actively canceling out the vote of a law-abiding citizen,” Boyle said in a public statement.
“This is not a victimless crime, quite the opposite. Every voting citizen is a victim every time,” Boyle continued. “These indictments should serve as a stark warning to anyone contemplating voting illegally in our 2026 election: we are watching, we will find you if you do it, and we will prosecute you.”
On the same day, Sen. Dick Durbin, D-Ill., the ranking member of the Senate Judiciary Committee, accused the Justice Department and the Department of Homeland Security of undermining state control over elections.

“Over the last year, DOJ and the FBI have seized ballots, threatened election officials, and worked with DHS in an attempt to undermine the election administration powers of states,” Durbin said in a post on X.
In late September, Durbin was among more than 30 Democrat Senators that signed onto a letter demanding accountability from the DOJ and DHS regarding election enforcement actions.
On Friday, Attorney General Todd Blanche responded to Durbin on X.
“Got your letter—after millions of illegal aliens flooded our country for four years and we’ve proven noncitizens and aliens have been voting since then, if you were really concerned about election integrity, you would help this administration clean voter rolls in your state and ensure the votes of millions of American citizens are protected,” Blanche posted.
Homeland Security Secretary Markwayne Mullin also commented on his agency’s efforts to secure elections.
“Our message to aliens who vote in American elections is clear: we will find you, arrest you, and you will face the consequences, including criminal charges and deportation,” Mullin said in an X post that referenced a September indictment of a noncitizen living in Minnesota who allegedly voted in the 2024 election.
The individuals in North Carolina were arrested after the indictments. Of those who allegedly voted, Eduardd Omar Majano Sosa, 22, of El Salvador, is the only one the Justice Department identified as an illegal alien.
The other noncitizens who allegedly cast illegal votes in the 2024 election were lawful permanent residents. Only citizens can vote under federal and state laws.
They were Gjina Gojcaj McDonald, 60, a native of the former Yugoslavia; James Edward Herrmann, 47, a native of Germany; Karl Fout, 73, a native of Germany; Lawton Caswell McKenzie, 46, a native of Jamaica, who allegedly voted in 2024, 2020, and 2012; Lionel Paul, 62, a native of Haiti; Ludgardys Olena Matthews, 62, a native of Panama, who allegedly voted in 2024, 2020, and 2018; Mervin Sylvester Bogle, 60, a native of Jamaica; Ramona Abreu-Exia, 71, a native of Germany, who allegedly voted in 2024, 2020, 2018, 2016, 2012, 2010, 2008, and 2004; and Robert Harold Corbett, 69, a native of Canada, who allegedly voted in 2024, 2016, 2004, 2002, 2000, and 1998.
The previous week, a federal grand jury in Missouri indicted Andres Garcia, 64, a Cuban national lawfully in the United States, for allegedly voting in the 2024 and 2022 elections.
On the civil front, the Justice Department sued California, accusing state election officials of failing to take action regarding more than 20,000 “likely” noncitizens whom Justice Department officials identified on the voter rolls.
The 2026 North Carolina Senate race is closely watched, featuring former Democrat Gov. Roy Cooper and former Republican National Committee Chairman Michael Whatley.
