Virginia Removed 6,531 Declared Noncitizens From Voter Rolls Over 2 Years

Virginia removed 6,531 noncitizens from its voter registration rolls over the last two years, according to public records obtained by Judicial Watch.

The Virginia Department of Elections classified each as a “declared noncitizen” removed from the state’s voter registration lists between June 2024 and June 2026. The state produced no record of whether the noncitizens voted, according to Judicial Watch. As the list only includes registered voters who declared themselves noncitizens, the actual number of registered noncitizens potentially could be higher.

The findings come as the administration of President Donald Trump has emphasized the need for states to maintain their voter rolls.

“It is disturbing beyond belief that as many as 6,531 noncitizens were registered to vote in Virginia. Judicial Watch is demanding more details and so should federal law enforcement, especially as Virginia is set to stop removing declared noncitizens from the rolls in the run-up to the November election,” Judicial Watch President Tom Fitton said in a public statement.

“These Virginia numbers show that the New Jersey noncitizen voter scandal is just the tip of the iceberg and is a national crisis,” Fitton added.

Earlier this month, the Department of Homeland Security released estimates that four states, California, New Jersey, Nevada, and Pennsylvania, had 256,463 noncitizens on the voter rolls. For its part, New Jersey admitted to finding 6,600 noncitizens on its voter rolls, significantly fewer than the federal estimate of 35,000. Of the 6,600 noncitizens, the state said that fewer than 400 voted.

Separately, the 25 states that are participating in the Department of Homeland Security’s Systematic Alien Verification for Entitlements database, used to cross-check voter registration data, identified at least 28,000 noncitizens on the voter rolls so far, according to DHS.

In April, Virginia settled with the Campaign Legal Center and other left-leaning groups over its policy of removing declared noncitizens from voter rolls, agreeing to pause the effort within the 90-day period before federal elections.

In practice, Virginia’s Department of Motor Vehicles compiles a list of individuals who check “no” in response to the question “Are you a citizen?” in an online portal.

According to Judicial Watch, the registrars then send those individuals a notice of intent to cancel after independently confirming their information matches a voter registration record. The state then allows the person 14 days to submit a sworn statement confirming citizenship, without which the registrar must then cancel their registration. However, the number obtained by Judicial Watch would not include noncitizens who falsely claimed citizenship and signed up to vote.
